DESCRIPTION OF SERVICES
Through our web site, RIXIR provides you with access to services which are subject to this "TOS". RIXIR provides services to both its Subscribers and non-Subscribers and each class is governed by this "TOS".

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although RIXIR reserves the right to change prices of accounts, or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary following the date the account was established. Customers will be expected to renew their account at least five business days prior to the end of their prepay period.

In situations where the account holder does not renew his/her account RIXIR will immediately suspend the service until the outstanding charge is processed successfully. In addition, RIXIR reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the account is suspended, or canceled.

All invoices will be sent directly to customers via E-mail after the purchase of services has been made.

UNSOLICITED COMMERCIAL E-MAIL (SPAM)
Spam (unsolicited bulk e-mail) & Undesirable E-mail Services - No spamming is allowed. We reserve the right to cancel anyone spamming immediately and without refund. We also reserve the right to cancel without refund, anyone who causes our company to be blocked by any e-mail service - this includes selling bulk-emailing software and/or e-mailing lists. Spammers will be procecuted to the fullest extent of the law.

If you are found to be engaging in any of the above activities, your account will be terminated without warning and you will not be entitled to any refunds that you would otherwise have been entitled to.

PERSONAL AND NON-COMMERCIAL USE LIMITATIONS
Unless otherwise specified, the services are for commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, give, or sell any information, software, products or services obtained from the services provided within the RIXIR web site.

MEMBER ACCOUNT, PASSWORD, AND SECURITY
If any of the services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password (or will be provided with one) although your user name may comprise of your current email address. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify RIXIR immediately of any unauthorized use of your account or any other breach of security. RIXIR will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by RIXIR, or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

UNLAWFUL OR PROHIBITED USE
As a condition of your use of the services, you will not use the services for any purpose that is unlawful, or prohibited by these terms, conditions, and notices. You may not use the services in any manner that could damage, disable, overburden, or impair any RIXIR server, or the network(s) connected to any RIXIR server, or interfere with any other party's use and enjoyment of any services. You may not attempt to gain unauthorized access to any services, other accounts, computer systems or networks connected to any RIXIR server or to any of the services, through cracking/hacking, password mining or any other means. You may not obtain or attempt to obtain any materials, or information through any means not intentionally made available through the services.

DISCLAIMER
RIXIR will not be responsible for any damages your business may suffer. RIXIR makes no warranties of any kind, expressed or implied for services we provide. RIXIR disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, server malfunctions, missed backups, non-deliveries, wrong delivery, and any and all service interruptions caused by RIXIR's proprietors and their employees. RIXIR reserves the right to revise its policies at any time.
